1. Agreement to Terms

By accessing or using DetailBrain ("the Service"), operated by Smith Web Co. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These terms apply to all users of the Service, including business owners, staff members, and any individuals granted access to your account.

2. Description of Service

DetailBrain is a web-based platform for auto detailing businesses that provides scheduling, customer relationship management, invoicing, payment processing, team management, and related business tools. The Service is provided on a subscription basis.

3. Account Registration

• You must provide accurate, complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old to create an account.
• One person or business may not maintain more than one free trial account.

Notify us immediately at support@detailbrain.com if you suspect unauthorized access to your account.

4. Subscription and Payments

Free trial

New accounts receive a 14-day free trial with full access to the Service. No credit card is required to start a trial. At the end of the trial, you must subscribe to a paid plan to continue using the Service.

Billing

Subscriptions are billed monthly or annually, depending on the plan you select. Payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Price changes

We may change our prices from time to time. Price changes will not apply to your current billing period. We will notify you at least 30 days before any price increase takes effect. Early adopter pricing is locked in for as long as your subscription remains active and in good standing.

Refunds

Subscription fees are non-refundable except where required by law. If you cancel mid-cycle, you retain access until the end of your current billing period.

5. Your Data

You retain ownership of all data you upload to or create within DetailBrain, including customer records, booking information, invoices, photos, and documents ("Your Data").

You grant us a limited license to store, process, and display Your Data solely for the purpose of providing the Service. We will not access, use, or share Your Data for any other purpose except as described in our Privacy Policy.

You are responsible for the accuracy and legality of Your Data. You must have the right to collect and store any customer information you enter into the Service, including compliance with applicable privacy laws.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or its infrastructure
• Upload malicious code, viruses, or harmful content
• Resell, sublicense, or redistribute the Service without our written consent
• Use the Service to send unsolicited bulk communications (spam)
• Scrape, crawl, or use automated tools to extract data from the Service

We reserve the right to suspend or terminate accounts that violate these terms.

7. Payment Processing

DetailBrain integrates with third-party payment processors, including Stripe and Authorize.net, to enable you to accept payments from your customers. Your use of these payment services is subject to their respective terms of service and privacy policies.

We are not responsible for the actions, omissions, or errors of third-party payment processors. Any disputes regarding payment processing should be directed to the applicable processor.

8. Availability and Support

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience outages from time to time.

Support is provided via email at support@detailbrain.com during business hours. Early adopter accounts receive priority support with direct access to our team.

9. Cancellation and Termination

By you

You may cancel your subscription at any time from your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. You retain access to the Service until then.

By us

We may suspend or terminate your account if you violate these terms, fail to pay subscription fees, or engage in activity that harms the Service or other users. We will provide reasonable notice when possible.

After termination

Upon cancellation or termination, your data will be retained for 90 days, during which you may export it or request a copy. After 90 days, your data will be permanently deleted. You may request immediate deletion at any time.

10. Limitation of Liability

To the maximum extent permitted by law, Smith Web Co. and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

12. Indemnification

You agree to indemnify and hold harmless Smith Web Co. from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.

13. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the state or federal courts located in Tarrant County, Texas.

14. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify you by email or through a notice in the platform at least 30 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.
